SUBJECT : Education technology: grants: requirements

DIGEST : This bill requires that school technology plans
include a component to educate pupils and teachers on the
appropriate and ethical use of information technology in
the classroom, Internet safety, the manner in which to
avoid committing plagiarism, the concept, purpose and
significance of a copyright, and the implications of
illegal peer-to-peer network file sharing. Districts would
not be required to change existing plans until their
current plan expires or is voluntarily replaced.

ANALYSIS : Current law requires a school district to have
a three to five year technology plan as a condition of
receiving an education technology grant administered by the
California Department of Education (CDE). The CDE is
required to maintain, and make publicly available to
interested agencies, a record of school districts with such
a plan. The State Board of Education is authorized to
waive the technology plan requirement if it determines
that, despite a good faith effort, the district cannot
develop the plan before receipt of a grant for reasons
beyond its control.
This bill:
1. Requires the Superintendent of Public Instruction, by
July 1, 2007, to develop guidelines and criteria for
inclusion in the education technology plan required of
all school districts receiving grant funding. The
guidelines and criteria shall include a component to
educate students and teachers on the appropriate and
ethical use of information technology in the classroom,
Internet safety, the manner in which to avoid committing
plagiarism, the concept, purpose, and significance of
copyrights, and the implications of peer to peer file
sharing.
2. Excepts school districts that have a current, legally
compliant, three to five year education technology plan
on July 1, 2008, from the bill's requirements until
after the current plan expires, or is voluntarily
replaced.
Comments
Need for the bill . According to the author's office, the
greatest users of peer-to-peer networks for the illegal
trading of copyrighted material (film and music) over the
Internet are 18 to 24 year olds. This activity has
resulted in multi-billion dollar losses, particularly in
the music and film entertainment industries. An
educational program targeted at students could help stem
this activity.

Minor, absorbable costs. The cost to develop guidelines
and criteria is estimated at $30,000 (0.25 personnel
years). Funding for these costs would be part of a Budget
Change Proposal request the CDE is drafting for the 2007-08
fiscal year to provide mandated technology plan approval.
